How it works

Frequently asked questions
- What is the difference between a 시말서 and a 경위서?
- A 시말서 admits fault and promises it will not happen again; a 경위서 only sets out what happened. Switching the document changes the title, the third heading and the closing sentence.
- Can an employer make me write an apology?
- An employer may ask for an account of what happened, but Korea’s Supreme Court held in 2010 that forcing an employee to write an apology violates freedom of conscience. If you do not accept the fault, the 경위서 reports the facts without it.
- Is this legal advice?
- No. If it may lead to discipline or dismissal, talk to a labour attorney (노무사) or the Ministry of Employment and Labour’s helpline, 1350.
