Frequently asked questions

How long does the tenant have?
30 days for a home lease extended without a term (art. 46, § 2), for one running over five years (art. 47, V) and for a commercial lease without a term (art. 57); 90 days for a buyer, who must give notice within 90 days of registering the purchase (art. 8).
What if the person lives there for free?
That is a comodato, not a lease. After the notice runs out the occupant owes a rent the owner sets (Civil Code art. 582) and faces an action to recover possession.
