Frequently asked questions
- Is the declaration enough?
- For an individual it is presumed true (Code of Civil Procedure, art. 99, § 3). The judge can refuse only if the file shows otherwise, and must first let you prove it.
- Is it the same as a declaração de pobreza?
- Yes. That is the older name, from Law 1.060/1950; since the 2015 Code the request follows articles 98 to 102.
- Is what I type uploaded?
- No. The PDF is made in your browser and nothing you type leaves your device.
- Is this legal advice?
- No, it is a form. Brazil’s Defensoria Pública gives free legal help to those who cannot pay a lawyer.
